Terms of Service

1. Acceptance of Terms

By accessing or using the website located at torvess.com (the "Site"), creating an account, completing a booking, or otherwise using our services, you ("you" or "Traveler") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Cookie Policy, and any additional policies or guidelines incorporated by reference. Please read these Terms carefully before using the Site. If you do not agree, do not access or use the Site or our services.

If you are making a booking on behalf of other travelers, you represent and warrant that you have actual authority to accept these Terms on each traveler's behalf and that each traveler has been informed of, and agrees to, these Terms.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Material changes will be communicated via email or a prominent notice on the Site. Your continued use of the Site after any revision constitutes your acceptance of the updated Terms.

2. Who We Are — Agency Relationship

TORVESS ("TORVESS," "we," "us," or "our") is a limited liability company organized under the laws of the United States, with its principal place of business at Business address — published before bookings open. TORVESS operates the online travel agency located at torvess.com.

We are an agent, not a supplier. TORVESS acts solely as an intermediary booking agent between you and the independent travel suppliers—airlines, hotels, car rental companies, ground transportation operators, and other service providers (collectively, "Suppliers")—that own and operate the travel products and services ("Travel Services") available through the Site. We do not own, operate, manage, or control any aircraft, vessel, hotel property, car rental fleet, or other travel facility.

Each booking you complete through our Site creates a direct contract between you and the relevant Supplier, governed by that Supplier's own terms and conditions, fare rules, and cancellation policies ("Supplier Terms"). You agree to be bound by the applicable Supplier Terms for every booking you make. We strongly encourage you to read the Supplier Terms and fare rules in full before confirming any purchase; they will be displayed or linked at checkout.

Our role is limited to facilitating the booking transaction, processing payments in our capacity as the Supplier's limited payment agent, and providing customer support in connection with your booking. TORVESS is not responsible for the acts, omissions, errors, representations, warranties, breaches, or negligence of any Supplier, or for any personal injury, death, property damage, or other damages or expenses resulting from any Supplier's conduct.

3. Account Registration & Eligibility

You must be at least 18 years of age to create an account or make a booking through the Site. By using the Site, you represent and warrant that:

  • You are at least 18 years old and have the legal capacity to enter into a binding contract;
  • All registration and booking information you provide is accurate, current, and complete;
  • You will promptly update your information if it changes;
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account; and
  • You will notify us immediately at support@torvess.com if you become aware of any unauthorized access to or use of your account.

You may not create an account or make a booking on behalf of another person without that person's express prior consent. One account per person is permitted; you may not maintain duplicate accounts.

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used in a manner we determine, in our sole discretion, to be fraudulent or harmful.

4. The Booking Process

When you search for Travel Services on the Site, we display options sourced from our Supplier partners. Availability, prices, and conditions are set entirely by Suppliers and may change at any moment prior to booking confirmation.

A completed, confirmed booking requires all of the following steps:

  1. You have provided all required traveler information (names, dates of birth, passport details as applicable, and contact information);
  2. You have reviewed and expressly accepted these Terms and the applicable Supplier Terms and fare rules;
  3. Your payment method has been successfully authorized (see Section 6 below); and
  4. We have received explicit confirmation from the Supplier and have issued you a booking confirmation number by email.

Until all four steps are complete, no booking exists and no charge will be made or captured. Please review your confirmation email carefully and contact us immediately if any information appears incorrect. Corrections after confirmation may be subject to Supplier change fees.

Fares and prices displayed are subject to change until confirmed. In the event of a manifest pricing error (a price that is materially and obviously inconsistent with prevailing market rates due to a technical or clerical error), we reserve the right to cancel the booking and issue a full refund of any captured amount, with prompt notification to you.

5. Price Display & Currency

You may select your preferred display currency on the Site. However, all transactions are settled in United States Dollars (USD). Prices displayed in non-USD currencies are indicative only and are calculated using exchange rates that may fluctuate between display and payment. The exact USD amount charged will appear on your payment statement. Your card issuer or bank may apply its own currency conversion rate and foreign transaction fees, for which TORVESS is not responsible.

Displayed prices generally include the base fare or room rate and, where technically possible, estimated applicable taxes and fees. The total price—including all taxes, fees, and any TORVESS service fee—is itemized and displayed at the checkout review screen before you confirm your purchase. Some destination-specific charges (such as resort fees, city taxes, destination facility charges, or fuel surcharges) may be collected directly by the Supplier at the property or point of service and are not included in the amount we collect.

6. Payment Authorization & Capture

All payment processing is handled by Stripe, Inc., our third-party payment processor. By providing your payment details, you authorize Stripe to process transactions on behalf of TORVESS in its capacity as limited payment agent for the applicable Supplier. TORVESS does not store, access, or retain your full card number, CVV, or other sensitive payment credentials; these are handled exclusively by Stripe in accordance with PCI DSS standards.

Authorization Hold

When you submit your booking and payment details at checkout, Stripe places an authorization hold on your payment method for the total booking amount. An authorization hold temporarily reserves the funds but does not transfer any money. Your available credit or account balance will be reduced by the hold amount, but no funds are debited or transferred to TORVESS or the Supplier at this stage.

Capture After Supplier Confirmation

The authorization hold is captured—converted into an actual charge—only after the relevant Supplier confirms your booking. We initiate capture promptly upon receiving Supplier confirmation, typically within a few minutes of your checkout.

Automatic Release if Not Confirmed

If the Supplier does not confirm your booking within 30 minutes of your checkout submission, the authorization hold is automatically released and no charge is made. We will notify you by email if your booking is not confirmed. Your financial institution's policies determine how quickly released funds become available; this typically ranges from immediate to several business days.

Booking Failures After Capture

In the unlikely event that a technical error results in a capture occurring before Supplier confirmation, or a booking fails after capture, we will process a full refund promptly. See our Refund Policy for applicable timelines.

7. Taxes, Fees & Charges

All bookings may be subject to applicable government taxes, airline and airport charges, hotel occupancy taxes, car rental surcharges, and similar levies ("Taxes and Fees"). These charges are determined by Suppliers, government authorities, and applicable law—not by TORVESS—and are subject to change without notice.

TORVESS may charge a service fee for booking facilitation. Any such fee will be clearly disclosed at checkout before you confirm your purchase. Service fees may be non-refundable even when the underlying Travel Service is cancelled or refunded; see our Refund Policy for details.

You are solely responsible for any taxes applicable to you personally as a result of purchasing Travel Services, including any income, gift, or other tax obligations under applicable law.

8. Changes & Cancellations

Your ability to change or cancel a booking, and any fees or refund amounts applicable, are governed entirely by the Supplier Terms and fare rules for your specific booking. TORVESS does not set these policies and cannot waive or override them. Fare rules are displayed during checkout and are available in your booking confirmation. Please read them carefully before completing your purchase.

Common fare types include:

  • Flexible / Refundable: Changes and cancellations permitted with little or no fee, subject to the Supplier's specific policy.
  • Semi-flexible: Changes or cancellations permitted but subject to a Supplier-imposed fee.
  • Non-refundable / Non-changeable: No refund or change permitted after booking confirmation. See Section 15 of our Refund Policy.

To request a change or cancellation where the fare rules permit:

  • Log in and use the Manage Booking tool at torvess.com; or
  • Contact our support team at support@torvess.com, support@torvess.com, or via 24/7 live chat or Telegram.

Changes are subject to Supplier availability at the time of the request. We may charge a booking modification service fee in addition to any Supplier-imposed change fee. All fees will be disclosed before you confirm any change.

9. Travel Documents, Passports & Visas

You are solely and entirely responsible for ensuring that you and all travelers named on your booking hold all required travel documentation, including but not limited to:

  • Valid passports with sufficient validity (many countries require a minimum of six months' validity beyond your travel dates);
  • Visas, electronic travel authorizations (such as the U.S. ESTA, Canada ETA, or EU ETIAS), and entry permits required for your destination and any transit countries;
  • Transit visas required for layovers, even if you do not leave the international transit area;
  • Health-related documentation including vaccination certificates, test results, or health declarations as required by destination or transit authorities; and
  • Any other documentation required by airlines, ports of entry, or applicable law.

Any information about document requirements that appears on the Site or is provided by our support team is offered as a general convenience only and may not reflect the most current requirements. Requirements change frequently; you must independently verify all entry and transit requirements directly with the relevant embassies, consulates, government authorities, and airline carriers before your travel date.

TORVESS is not responsible or liable for any costs, losses, damages, or consequences arising from your failure to hold the required travel documents. Airlines and border agencies may deny boarding, transit, or entry to travelers who do not satisfy applicable requirements. Any costs that result—including the cost of non-refundable tickets, hotel nights, or return transportation—are your sole responsibility.

10. Schedule Changes & Irregular Operations

Suppliers, particularly airlines, may alter schedules, routes, aircraft types, or service offerings at any time. Minor schedule changes (the threshold varies by Supplier but is often defined as 60–90 minutes or fewer) generally do not entitle you to a free rebooking or refund under applicable fare rules.

In the event of a significant schedule change, flight cancellation, lengthy delay, diversion, or other irregular operation, your rights—including any entitlement to re-accommodation, meals, hotel accommodation, or refund—are determined by: (a) the applicable Supplier Terms and fare rules; (b) relevant passenger rights laws in the country of departure or the applicable regulatory regime; and (c) any applicable travel insurance coverage you hold. TORVESS will use commercially reasonable efforts to notify you of material schedule changes and to assist you in understanding and pursuing your options, but we cannot guarantee or expand upon the remedies the Supplier is obligated to provide.

You are responsible for keeping your contact details current in your booking and checking your itinerary status before travel. We recommend checking in online as early as permitted and confirming your itinerary directly with the Supplier within 24–48 hours of departure.

11. Supplier Insolvency & Force Majeure

TORVESS is not responsible or liable for the failure of any Supplier to perform its contracted obligations, whether due to insolvency, bankruptcy, cessation of operations, or any event beyond our or the Supplier's reasonable control. Force Majeure Events include, without limitation: acts of God; natural disasters (earthquakes, floods, hurricanes, wildfires); epidemics or pandemics; war; terrorism; civil unrest; government orders, sanctions, or border closures; labor disputes or strikes; or failures of critical infrastructure.

In the event of a Supplier insolvency or Force Majeure Event, your primary remedies will generally lie against the Supplier directly, your travel insurance provider (if applicable), and your credit card issuer (through chargeback rights under applicable card network rules). TORVESS will make commercially reasonable efforts to assist you in identifying and pursuing available remedies, but our liability in such circumstances is limited as described in Section 16.

We strongly recommend that all travelers purchase comprehensive travel insurance that includes trip cancellation, trip interruption, and supplier insolvency coverage before travel.

12. Coupons & Promotional Offers

TORVESS may issue promotional discount codes, coupons, credits, or other offers ("Coupons") from time to time. Use of any Coupon is subject to these Terms and any specific terms stated in connection with the offer. The following conditions apply to all Coupons unless expressly stated otherwise:

  • One per booking. Only one Coupon may be applied per booking. Coupons may not be combined.
  • Eligibility restrictions. Coupons may be subject to minimum purchase thresholds, eligible Travel Service types, specific travel dates or booking windows, or geographic restrictions.
  • No cash value. Coupons have no monetary value, cannot be redeemed for cash, and cannot be applied to previous or already-confirmed purchases.
  • Non-transferable. Coupons issued to a specific user account may not be transferred, sold, or shared with other users.
  • Expiry. Coupons expire on the date stated in the offer. Where no expiry date is stated, we reserve the right to withdraw any Coupon at any time without prior notice.
  • Capped redemptions. We may limit the total number of times a Coupon offer may be redeemed. Once the cap is reached, the Coupon is no longer valid.
  • Withdrawal. We may modify, suspend, or withdraw any Coupon program at any time. Withdrawal does not affect Coupons already validly applied to a confirmed booking.
  • Fraud prevention. Coupons obtained through unauthorized channels or used in violation of these Terms are void. We reserve the right to cancel bookings and recover the value of fraudulently used Coupons.

13. Prohibited Conduct

You agree that you will not use the Site or our services to:

  • Violate any applicable local, state, national, or international law or regulation;
  • Make any speculative, false, or fraudulent reservation or booking, or any booking in anticipation of demand;
  • Access, monitor, or copy any content or information from the Site using any robot, spider, scraper, automated tool, or other automated means without our prior written permission;
  • Circumvent, disable, or otherwise interfere with security features or access controls of the Site;
  • Resell, redistribute, or commercially exploit bookings or any Site content without our prior written consent;
  • Impersonate any person or entity, or misrepresent your identity or affiliation with any person or entity;
  • Transmit any viruses, malware, ransomware, or other harmful or disruptive code;
  • Interfere with or disrupt the integrity or performance of the Site, servers, or networks;
  • Collect or harvest personal data about other users without their consent; or
  • Engage in any conduct that restricts or inhibits any other person from using or enjoying the Site.

We reserve the right to terminate or suspend your account, cancel any bookings made in violation of this section, and pursue all available legal remedies. We may report violations to law enforcement authorities.

14. Intellectual Property

All content on the Site—including text, graphics, logos, icons, images, audio clips, video clips, data compilations, page layouts, and underlying software (collectively, "Content")—is owned by or licensed to TORVESS and is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for your own personal, non-commercial travel planning and booking purposes. This license does not include the right to: reproduce, distribute, publicly display, publicly perform, sublicense, sell, or modify any Content; create derivative works based on any Content; or use any data mining, robots, or similar data gathering or extraction methods.

The TORVESS name, wordmark, logo, and all related product names, service names, slogans, and trade dress are trademarks or service marks of TORVESS. You may not use any of our marks without our prior written permission. All other trademarks referenced on the Site are the property of their respective owners.

If you believe that any Content on the Site infringes your copyright, please contact us at support@torvess.com with sufficient detail to allow us to identify and evaluate the alleged infringement.

15. Disclaimers of Warranty

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, SERVICES, AND PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TORVESS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, TORVESS does not represent or warrant that: (a) the Site will be available at all times, uninterrupted, or error-free; (b) defects in the Site will be corrected; (c) results obtained from use of the Site will be accurate, reliable, or complete; (d) Travel Services provided by Suppliers will meet your expectations as to quality, safety, fitness, legality, or any other standard; or (e) any information on the Site regarding visa, entry, or health requirements is current, accurate, or applicable to your specific circumstances.

Customer ratings, reviews, and descriptions of Travel Services displayed on the Site are provided for informational purposes only and do not constitute an endorsement, guarantee, or warranty by TORVESS regarding any Supplier or Travel Service.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TORVESS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE SITE OR ANY TRAVEL SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY, INCLUDING SUPPLIERS; (C) ANY CONTENT OBTAINED FROM THE SITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. THIS EXCLUSION APPLIES EVEN IF TORVESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).

IN NO EVENT WILL TORVESS'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY TRAVEL SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO TORVESS IN CONNECTION WITH THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100).

Some jurisdictions do not permit the exclusion or limitation of certain types of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms limits liability that cannot be lawfully limited, including liability for fraud, willful misconduct, or personal injury caused by our negligence.

17. Indemnification

You agree to indemnify, defend (at TORVESS's option), and hold harmless TORVESS, its affiliates, officers, directors, employees, contractors, and agents (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site or any Travel Services; (b) your breach or alleged breach of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party right, including any intellectual property right or privacy right; or (e) any failure to hold required travel documents or to comply with entry, transit, or health requirements.

We reserve the right to assume exclusive control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

18. Dispute Resolution & Arbitration

Please read this section carefully. It contains a binding arbitration clause and class action waiver that affect your legal rights.

Informal Resolution

Before initiating any formal legal proceeding, you agree to contact our resolutions team at support@torvess.com with a written description of the dispute, the relief sought, and your contact information. We will endeavor to resolve the dispute informally within 30 days. This informal process is a prerequisite to filing any arbitration claim.

Binding Arbitration

If the dispute is not resolved informally, you and TORVESS agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any Travel Services purchased through the Site shall be resolved exclusively by binding individual arbitration, rather than in court, except as set out in the small claims and opt-out provisions below. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and applies to all disputes regardless of whether they sound in contract, tort, statute, or any other legal theory.

Arbitration shall be administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules, available at www.adr.org. The arbitrator has exclusive authority to determine questions of arbitrability, including challenges to the enforceability of this agreement. Arbitration proceedings may be conducted in writing, by video conference, or at a location mutually agreed by the parties in the State in which TORVESS is organized.

Small Claims Court Carve-Out

Either party may bring an individual claim in a small claims court of competent jurisdiction, provided that the claim falls within that court's jurisdictional limits and seeks only individual, non-class relief.

Class Action Waiver

YOU AND TORVESS EACH AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person's claims, may not preside over any form of class or representative proceeding, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that individual's claim.

30-Day Right to Opt Out of Arbitration

You have the right to opt out of this binding arbitration agreement by sending written notice to support@torvess.com within 30 days of the date you first agree to these Terms (i.e., the date of your first use of the Site or first booking, whichever is earlier). Your opt-out notice must include: your full name, your account email address, your mailing address, and a clear statement that you wish to opt out of the arbitration provision in these Terms. If you opt out, you and TORVESS may not invoke the arbitration provision against each other; all other provisions of these Terms remain fully in effect.

Severability of Arbitration Provisions

If any portion of this Section 18 is found invalid or unenforceable, the invalid or unenforceable portion will be severed and the remaining provisions will remain in full force and effect, except that if the class action waiver is found invalid or unenforceable, the entire arbitration agreement in this Section 18 shall be null and void.

19. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State in which TORVESS is organized, without giving effect to any choice-of-law or conflict-of-law rules. Any disputes not subject to arbitration under Section 18 shall be resolved exclusively in the state or federal courts of competent jurisdiction located in the State in which TORVESS is organized, and you and TORVESS each irrevocably consent to personal jurisdiction and venue in those courts.

TORVESS is registered as a seller of travel in the following states. State registration does not constitute endorsement, approval, or recommendation of TORVESS's services by any state government or agency.
